..... ound excess stock only of Rs. 3,61,680, which was subsequently deleted in appeal by the Assistant Commissioner of Commercial Tax and thus, there was no excess stock at all. The Assessing Officer allowed only 30 per cent. deduction from the total value of stock taken by the survey team and after adopting gross profit rate of 12.5 per cent., has arrived at the excess stock at Rs. 28,46,395 and has added the same. Against which the assessee preferred the first appeal. It was argued, before the learned Commissioner of Income-tax (Appeals), inter alia, that the survey team did not value the stock, found at the time of survey, correctly. ..... he entire addition made on account of excess stock, but the survey by sales tax authorities may be different from various angles. Yet, there is a judicial dictum that whatever stock is found in survey done by the Sales Tax Department can be adopted in the income-tax proceedings also. It is also an undisputed fact that the assessee had started its business just in the previous year. After going through the grounds raised in the cross-objection as well as the grounds raised in the Revenue s appeal, we find that the learned Commissioner of Income-tax (Appeals) findings are quite justifiable and no interference is called for.
