All concerned exporters are hereby informed that Bank Realisation Certificates (BRC) are pending for submission by the Exporters in respect of huge number of drawback shipping bills filed during the period from 01.04.2013 to 31.03.2014, as a result of which, updating the data in the BRC module in the ICES and monitoring the realisation of BRCs/negative statements issued by the Authorised Dealer Bank/Chartered Accountant in the capacity of a Statutory auditor, has not been possible. 2. Your attention is also invited to the Board's Circular No. 05/2009-Cus dated 02.02.2009 wherein it is mandatory for all exporters to submit BRC/Negative statement in the prescribed Annexure every six months i.e., for the period from January to June and July to December. 3. The detailed list of shipping bills for which BRC/negative statements are not submitted as per the system data in respect of shipping bills whose Let Export Order date is falling between 01.04.2013 and 31.03.2014 is published in the Customs Bangalore website www.bangalorecustoms.gov.in. The said list is generated consequent to completion of entries of all the BRCs/negative statements/CA certificates submitted till date. 4. Further, it is seen that many of the BRCs/negative statements/CA/AD certificates submitted till date, are found deficient due to various errors related to AD codes such as non-registered AD codes, entry rejections by the system due to multiple AD codes etc., and hence, such documents could not be entered in the system. The Exporters are requested to rectify the same and resubmit all such relevant documents. In this connection, it is once again impressed upon the trade that, the Circular 05/2009- Customs dt. 02-02-2009, in terms of para 4 of, prescribes, along with BRCs, the option of submitting certificates from Chartered Accountant/Authorised dealer(s) AD-wise at each port for each of the six-monthly certificates. 5. All the concerned Exporters are hereby requested to submit the BRCs/Negative statements as per the Circular No. 05/2009 Customs dated 02.02.2009, preferably along with the correct AD Codes for making correct entries in the System, not later than 24.02.2016 so as to enable this office to update the data in the BRC module in the ICES. 6. Shri M.S. Krishnamurthy, Superintendent of Customs, Drawback Section, ACC, Bangalore has been appointed as Nodal Officer to receive the above said BRCs/Negative statement. In case of any difficulty they may meet Shri M.S.Krishnamurthy, Superintendent Nodal Officer (Telephone No.080-22001407) or Shri T. Senthil Kumar, Assistant Commissioner of Customs (Drawback) (Telephone No.080-22001408) for further enquiry or solution to their difficulty. 7. All the concerned Exporters are requested to take note of the above for suitable compliance by submitting the BRCs/negative statements within the stipulated date, failing which appropriate action available under the Customs Act, 1962 will be initiated to recover the drawback amount sanctioned along with interest.
