Cenvat Part II Register

Hi

We have to maintain CENVAT Part II Register.

when we claim for the refund of CENVAT credit, we have been told to debit the amount in the register.

so we debited the amount of refund we claimed in register (on the date of filing claim)

it was feb2015

but we received a less amount in the month of june 2015 as per our claim.

so how to adjust that difference amount??

also please provide excl copy of cenvat part II register.

please reply.

Dear Rudrayai Shedjale,

As we understand your query that you had filed refund claim and debited the availed CENVAT credit in the Month of February 2015. But in June 2015, you have received the refund claim but not equivalent to the debited amount. For this you may write to the Department that why this difference, and which part of refund claim was not allowed and specific reasons of the same.

Further RG 23A Part II has been abolished long time back and there is no statutory requirement to maintain this account. Simple debit/credit account in your Accounting software will suffice this need.

You have to seek corresspondence with the department, however please take a view of your refund order, It may be the case where department has mentioned in order that partial amount has been refunded and remaining can be taken back as cenvat.

As far as RG 23 Part II is concerned, please provide the e-mail on which excel copy can be sent.

yes they deducted certain amount giving the reason that we have availed the credit on services which are not eligible & also advised me not to take credit on such services like CHA services,commission, courier & asked me to reverse the same in the next quarter returns.

the reason & amount of deduction is clear to me. & as per their rules we wont take credit for those services in future (also the amount is very negligible)

all i want to ask is do i need to show it in my cenvat part II register??

we have already debited the amount of refund we claimed for.

so should i add the amount which we have not received(difference amount) & again debit the same as credit not admissible or just let it be as it is??

i am maintaining the same but i want to confirm whether is it correct or not.

also let me know the balance of it should match with the returns we file.

but if we debit the refund amount in cenvat part II register & we receive the same in terms of cheque then it cant be reflected in returns we file.

so finally when we match the closing balance from returns & cenvat part II there is that difference of refund amount.

is that okay??

Pl refer the Noti . No. 27/2012-CE (N.T.), Point No. 2 (i). The Wording is under:-

In case the amount of refund sanctioned is less than the amount of refund claimed, then the claimant may take back the credit of the difference between the amount claimed and amount sanctioned.
