Dear Sir,

Reference to Customs Notification No. 32/2016 [NT] that notified “Customs (Import of Goods at Concessional Rate of Duty for Manufacture of Excisable Goods) 2016 for availing duty concession/exemption on imported goods under Notifications issued under Section 25(1) of Customs Act 1961 for manufacture of excisable goods subject to fulfillment of certain conditions:

  1. One of the conditions is that importer shall make an application to DC/AC of Central excise
  2. Second condition is that importer shall execute continuity bond

The formats of application and bond are not been given in the said Rules 2016.

Thankful if anybody could help me to get the formats if already prescribed. If not, what is the alternate way to clear the goods under this Rule?

Dear Sir,

The application format has not provided in the notification itself, however there is requirement of filing information. The copy of which is to be submitted to Jurisdictional AC/DC and AC/DC of port of import.

Further the continuity bond format, you may refer old rules of Customs (import at concessional rate of duty).

Non-availability of prescribed pro forma/annexure in Notification No.32/16-Customs (N.T.) as amended vide Notification No.39/16-Customs (NT) dated 15.3.16 and earlier Notification No.36/96-Customs (NT) dated 23.7.96 means it is not required.(In corresponding rules of Central Excise, Annexures have been prescribed in Notification No.20/16-CE(NT) dated 1.3.16 itself).

Further, only surety bond is required to be executed. The condition of 'security' has been dispensed with vide Notification No.39/16-Customs (NT) dated 15.3.16. In Rule 5 (2) of these rules, the words, "or security" stand omitted.

Regarding bond pro forma, I agree with the reply of Sh. Pawan Kumar,an expert.

Can a milk producing excisable MS bars import duty free MS scrap from SEZ units who have scrap as their bye product generation under this exemption notification.
