Dear Experts,

We are the OEM capital goods manufacturer. Our material is ready to shipment, but due to the Corona Virus issue the receiving customer not approved for shipment. Hence please suggest to us, is there any customs provision to keep these materials at the customs warehouse under bond and then send the same in next month. Please explain to us the proper sections to start the process with knowledge.

Sir,

Export warehousing procedure was available under Central Excise Act,1944, vide notification no. 46/2001-Central Excise (N.T.) dated 26.06.2001 and Circular No. 581/18/2001- CX dated 29.06.2001. Under GST Regime such procedure is not available. However you may take up the issue with CBIC for prescribing a procedure for export warehousing under GST.

You can keep such goods in Customs Bonded Warehouse or Private Bonded Warehouse of the Customs Act 9162 as amended from time to time. You would have to refer Section 57 to 73A of the Customs Act read with Chapter: IX on Warehousing.
