please tell me the Tax filling date U/S 139 in case of merger.what's happend in case of company filling merger petition to high court, but final order is pending.either both company filled merged return of not filling the return due to merger proceeding. what is the excact treatment please tell me , It,s very urgent.

In my opinion individual return to be filed until the company receive the approval of scheme of amalgmation and order and further compliance of RoC.

Amalgamation becomes effective from the date of meeting in which it is agreed and not from the court sanction is given-Badarganj Loan Office Ltd Vs Shaharuddin Shah. However the amalgamation is subject to Court Approval.
