sales of capital goods imported under epcg scheme

An EPCG Licence is taken in 2004-05 on acutal user condition basis.

We have imported capital goods and after fulfilment of export obligation DGFT redeemed the licence in 2009.

Now Only Bond cancellation is pending at Custon,

We want to sale the capital goods so imported, is it possible - what compliance need to be  fulfill bec'z policy is cleares that actual user condition till the export obligation is fullfill. in our case e.o. is fulfill and licence is redeemed

 If there is suitable notification regarding sale of capital goods so imported under EPCG Licence, Please confirm.

Please refer para 2(2) of the  Notification No. 103 /2009-CUSTOMS dated 11 September, 2009 which enumerates that the goods imported shall not be disposed of or transferred by sale or lease or any other manner till export obligation is completed.  In your case, export obligation has been fulfilled therefore, you may sell the capital goods.

Further, please also intimate to the concerned authorities in this regard.
