It has been so held by the Apex Court in the case of Gebi Lal (348 ITR 361). It was also held by the Gujarat High Court that for the purposes of Explanation 5 to sec. 271(1)(c), it is sufficient if the disclosure is made during search and tax is paid before completion of assessment (299 ITR 305). Hence, the fact that tax was not deposited before filing of the return would not affect the immunity available to the appellant, as the search was initiated on 03.05.2007 in this case. According to the Department, the assessee was not entitled to immunity under clause (2) as he did not satisfy the third condition for availing of the benefit of waiver of penalty under section 271(1)(c) as the assessee failed to file his return of income on July, 31, 1987, and pay tax thereon particularly when the assessee conceded on August 1, 1987, that there was concealment of income.
