The Appellate Tribunal CESTAT, Mumbai allowed the modification application based on the case of Lloyds Steel Industries Ltd. v. UOI. The Tribunal waived further pre-deposit requirement and ordered the listing of the appeal for regular hearing as the assessee was finding it difficult to meet the full deposit order due to loss of business.
