2023 (2) TMI 1179 - SCH - Money LaunderingMoney laundering - If there is an acquittal/discharge in the scheduled offence, will the proceedings under the PMLA Act would still survive? - If one is not an accused in the scheduled offence, still independent proceedings can be initiated under the PMLA Act? - HELD THAT - Issue notice, returnable on 14.03.2023 (NMD). In the meantime, the parties shall maintain status quo with reference to the properties referred to in the order impugned.
The Supreme Court of India considered two questions in the case:
1. Whether proceedings under the PMLA Act would continue after an acquittal/discharge in the scheduled offence? 2. Can independent proceedings be initiated under the PMLA Act even if one is not an accused in the scheduled offence? Delay was condoned, and notice was issued for further proceedings. Parties were instructed to maintain status quo regarding the properties involved.
