.......and not merely may be guilty before a court can convict and the mental distinction between 'may be' and 'must be' is long and divides vague conjectures from sure considerations". As a result of the above, we accept the appeal, set aside the judgments of the. trial court and the High Court and acquit the accused. Appeal allowed.
