2005 (2) TMI 907 - MADRAS HIGH COURTExtract: ....... This part of the decree is against law and hence it is liable to be set-aside and accordingly it is set-aside. Consequently, A.S. No. 834 of 1989 filed by the plaintiff is allowed and A.S. No. 569 of 1989 filed by the defendant is dismissed; however there will be no order as to costs. The decree of the trial court shall stand modified accordingly.
