Request for Gratuity, Corporate Laws / SEBI / LLP

I am working in the private concern for the past 9 ½ years. due to my financial problem I need to take my provident fund after completing my 5 ½ years as per my management decided the withdrawal is only for P.F, so they didn’t provide my gratuity (there is no return statement). For the period of the three months I am working as contract person and I get the salary as a cheque. After three months again I join in the concern as a permanent employee. Now I resign my job and i get only 5 ½ years gratuity if there is any possibilities to get the balance 4 years gratuity.

Dear Rajesh,

As we understand from your query that there was no continuity of service for 9 - 1/2 years. Hence, you not been eligible to get the Gratuity for the balance 4 years.

You are eligible for gratuity if you complete continuous five years of service. If you give the chronological order of your service in the company then the eligibility may be checked out.
