Out of turn hearing of tax cases by S.C. & H.C. - Income Tax - 1632/CBDTExtract INSTRUCTION NO. 1632/CBDT Dated: June 26, 1985 Some issues under Direct Tax laws recur in a large number of cases. Therefore, so long as the issue is not finally resolved by the Supreme Court/High Court it generates Appeals and References at various levels. The Board has undertaken the exercise of identifying such issues pending before the Supreme Court. I shall be meeting the new Chief Justice of Supreme Court with the list of such issues and the cases thereon pending before the Supreme Court and make a request to him to hear them out of turn. I shall also be requesting him to constitute a Tax Bench on a regular basis. I would like you to carry out a similar exercise at your level and also call on the Chief Justice of the High Court to make a request to him for an out of turn hearing of cases pending before the High Court and involving important issues. Please keep me informed about the development of your meeting with the Chief Justice of the High Court.
