The Supreme Court held that the judgment of the High Court granting permission to the Public Prosecutor to withdraw from the prosecution under Section 494 of the CrPC, 1898 cannot be sustained. The Court emphasized that the ultimate guiding consideration for granting permission to withdraw must be the interest of administration of justice.
