2009 (6) TMI 12 - HC - CustomsFake and Forged DEPB Licences – Purchase of DEPB Licences from the open market and payment of customs duty – Department on verification found that DEPB licences issued from Tuticorin Customs were fake and forged documents. In these circumstances, since the petitioners had imported RBD Palmolein under various bill of entries without payment of duty by wrongly availing DEPB credit on fake and forged transferable licences to the tune of Rs.35,45,116/-, Rs.23,11,837/-, Rs.49,70,109/- and Rs.87,77,036/- it was found that the Department had incurred a heavy loss of revenue. Some the parties who sold the DEPB was also found missing – Petitioners challenged the issuance of SCN on various grounds including Jurisdiction and period of limitation - HC declined to quash the show causes notices and directed that, the petitioners to raise their objected before the adjudicating authorities and get the final order, writ petition dismissed - It is a trite law that this Court should not interfere against the show cause notice
