Dated: 08 October 2018 PUBLIC NOTICE NO.33/2018 Sub:- Examination to be conducted on 18.01.2019 by Commissionerate for grant of Custom Broker License Attention is invited to the communication received from the Directorate General of Performance Management, Customs and Goods and Service Tax, New Delhi (Annexure I) for the Customs Brokers Licence Written Examination. It is hereby notified to all that the written examination under Regulation 6 of the Customs Broker Licensing Regulations (CBLR), 2018 which is a pre-requisite for the grant of Customs Broker Licence, will be conducted on 18.01.2019 by this Commissionerate. 2. Regulation 5 of CBLR, 2013 prescribes the conditions to be fulfilled by the applicants for the examination, as mentioned below: The applicant for a licence to act as a Customs Broker in a Customs Station shall prove to the satisfaction of the Commissioner of Customs, that. (a) he is a citizen of India; (b) he is a person of sound mind; (c) he is not adjudicated as insolvent; (d) he holds an Aadhar number; (e) he holds a valid PAN card; (f) he has not been penalised for any offence under the Act, the Central Excise Act, 1944 (1 of 1944), the Finance Act, 1994(32 of 1994), the Central Goods and Services Act, 2017 (12 of 2017) and Integrated Goods and Services Tax Act, 2017 (13 of 2017); (g) he has neither been convicted by a competent court for an offence nor any criminal proceeding is pending against him in any court of law; (h) an individual applicant or in case the applicant is a firm, its partner or in the case of a company, its director or an authorised employee who may handle the Customs work shall- (i) be a graduate from a recognised University, and (ii) possess a professional degree such as Masters or equivalent degree in Accounting, Finance or Management, CA/MBA/LLB/ACMA/FCMA or Diploma in Customs Clearance work from any Institutes or University recognised by the Government or is having at least two years experience in transacting Customs Broker work as G-Card holder-, (i) the applicant has financial viability as evidenced by a certificate issued by a Scheduled Bank or such other proof acceptable to the Commissioner of Customs in terms of possession of assets of value of not less than five lakh rupees: (2) A retired Group A officer from the Indian Revenue Service (Customs and Central Excise)having a minimum of five years' experience in Group 'A' post shall also be eligible 'to apply for a license to act as a Customs Broker provided he satisfies the conditions specified at (a), (b), (c), (d), (e), (f), (g) and (i) above 3. The Commissioner of Customs may make such enquiries as he deems fit for the purpose of verifying the eligibility of the applicants before forwarding the applications to the Directorate General of Performance Management. 4. The Customs Broker License Holders permitted to operate AS per Regulation 11 (3) or 12(2) of CBLR, 2018, may also apply or nominate their employees/ Directors/ Partners possessing the qualifications mentioned in Para 2 above to appear for the written examination. 5. The candidates will have the option to answer either in Hindi or English. The syllabus of the examination is as per Regulation 6(7) of CBLR, 2018 . The candidates successful in the written examination will be called for an Oral Examination. A candidate needs to pass both the written as well as oral examination in order to be eligible for grant of License under Regulation 7 of CBLR, 2018. A maximum of 6 attempts is allowed for the applicant to clear the examination. 6. The applications for the examination, complete in all respect, shall be submitted either in person or vide Registered/ Speed Post in Form A ( Annexure II ) along with two passport size photos, self-attested copies of Aadhar, PAN card and other documents to prove citizenship, proof of educational qualifications, financial viability and other requirements as listed out in Annexure III . The Passport sized photo pasted on the Form A shall be attested by a Gazetted Officer. If the declarations and information submitted in the application is found to be incorrect in any respect the same shall be rejected or the license (if issued) shall be cancelled. 7. The complete application for the examination should reach the Deputy Commissioner of Customs (Import Bonds), Office of the Commissioner of Customs, Custom House, Cochin 682009 from 15.10.2018 to 16.11.2018 up to 06:00 PM . Incomplete applications, Applications received prior to the said Period and applications received after 06:00 PM, 16.11.2018 shall not be entertained under any circumstances. 8. The applicants are required to ensure the completeness of the application before its submission as no deficiency memo shall be issued and any incomplete application shall be summarily rejected. 9. The final list of the candidates found eligible to appear for the examination shall be published in the website of Cochin Customs as well as the Notice Board.
