Baggage (Second Amendment) Rules, 1992 - 43/92 - Customs - Non TariffExtract Baggage (Second Amendment) Rules, 1992 Notification No. 43/92-Cus. (N.T.) Dated 19-6-1992 In exercise of the powers conferred by sub-section (2) of section 79 of the Customs Act, 1962 (52 of 1962), the Central Government, being satisfied that it is necessary in the public interest so to do, hereby makes the following rules further to amend the Baggage Rules, 1978, namely :- 1. (1) These rules may be called the Baggage (Second Amendment) Rules, 1992. (2) They shall come into force on the 19th day of June, 1992. 2. In the Baggage Rules, 1978 (hereinafter referred to as the said rules) :- (i) in rule 3, - (a) for clauses (a) and (aa), the following clauses shall be substituted, namely :- "(a) in the case of passengers arriving from Maldives and Sri Lanka - (i) up to a value of Rs. 1500 in case the period of stay outside India does not exceed three days; (ii) up to a value of Rs. 3000 in case the period of such stay exceeds three days; and"; (b) in clause (b), for the words "two thousand and four hundred", the words "three thousand" shall be substituted; (c) in the first proviso, - (i) in paragraph (i), for sub-paragraph (a) and (aa), the following sub-paragraphs shall be substituted, namely :- "(a) in the case of passengers arriving from Sri Lanka and Maldives - (i) up to a value of Rs. 400 in case the period of stay outside India does not exceed three days : (ii) up to a value of Rs. 750 in case the period of such stay exceeds three days;"; (ii) for sub-paragraphs (ii) and (iii), the following sub-paragraph shall be substituted, namely :- "(ii) in the case of an air passenger who travels on a free or concessional ticket and returns to India after staying outside India, for less than ten days, articles up to a value to Rs. 300 in case of such adult passengers and seventy-five rupees in case of such passengers below eighteen years of age shall only be allowed, to be imported free of duty for each day's stay outside India."; (d) in the second proviso, for the words "one thousand and two hundred", the words "one thousand and five hundred" shall be substituted. 3. In rule 4 of the said rules, for the words "three thousand and six hundred", the words "four thousand and five hundred" shall be substituted. 4. In sub-rule (1) of rule 4A of the said rules, - (i) for the words "twenty-four thousand", the words "thirty thousand" shall be substituted; (ii) after condition (ii), the following explanation shall be inserted, namely :- "Explanation. - for the purposes of this sub-rule, the expression "working abroad" shall include Government officials who are deputed on training abroad." 5.In rule 5 of the said rules, for the words "six thousand", the words "seven thousand and five hundred" shall be substituted.
