Amendment to Notification No. 148/88-Cus. [Ch. 84] - 227/89 - Customs -TariffExtract Amendment to Notification No. 148/88-Cus. [ Ch. 84] Notification No. 227/89-Cus. Dated 23-8-1989 In exercise of the powers conferred by sub-section (1) of Section 25 of the Customs Act, 1962 (52 of 1962), the Central Government, being satisfied that it is necessary in the public interest so to do, hereby makes the following further amendments in the notification of the Government of India in the Ministry of Finance (Department of Revenue) No. 148/88-Customs, dated the 27th April, 1989, namely : - In the said Notification,- (1) the words "by any State Fisheries Corporation or any Fisheries Co-operative Federation recognised by the State Government concerned" shall be omitted, (2) for the words "section 3 of the said Customs Tariff Act,", the following shall be substituted, namely :- "section 3 of the said Customs Tariff Act, subject to the following conditions, namely - (1) the importer produces a certificate from an officer not below the rank of a Deputy Secretary of the Department concerned with fisheries in the State Government to the effect that the outboard motors being imported are for fitment to boats which are exclusively used for fishing operations and recommending the grant of the concession, and (2) the importer furnishes an undertaking to the Assistant Collector of Customs at the time of importation to the effect that - (i) the said outboard motors shall be used for the purpose specified above and he shall pay on demand in the event of his failure to comply with (1) above, an amount equal to the difference between the duty leviable on the said outboard motors, but for the exemption contained herein and that already paid at the time of importation : Provided that the conditions (1) and (2) specified above shall not apply in the case of imports of the said outboard motors by any State Fisheries Corporation or any Fisheries Co-operative Federation recognised by the State Government concerned."
