We are manufacturer exporters & status holder.

for our raw material unloading & loading we want to import forklift so can we clear the same under EPCG licence?

we are a plastic manufacturing company.

I support the views of Sh.Mukund Thakkar, Sir. Forklift is a truck and it is eligible only to mining sector. Go through Appendix 5F (serial No.4) of HBP 2015-20 as amended vide DGFT Public Notice No.47/2015-20 dated 6.12.2017.

In our view, You cannot import Fork Lift against EPCG without payment of applicable duties and taxes and there would be no nexus between Fork Lift and Manufacturing of Finished Goods. Further, Fork Lift is specifically mentioned as Non Transport Vehicle under the provisions of Motor Vehicle Act vide Notification S.O.1248(E) dtd 5th November 2004. Further you should also go through the definition of Capital Goods as mentioned in the Chapter 9 of the FTP 2015-2020 as valid till 30-09-2021.
