Hi, I am a Indian citizen who resided in USA for 10+ years and relocating back to India. Is it legal here in India to do options trading in USA after returning back to India? I know money remitted from India via LRS can't be used for derivatives trading but I don't know if trading US derivatives (OPTIONS) with money earned while in US is legal for an Indian citizen staying in India. The money that you have earned when you were in the US, have you kept it still in a bank account in the US or this has been brought to India and kept in a foreign currency account in India like EEFC? Or is this converted into INR and moved to NRE/NRO account? However, on going through entry k of Schedule I of Foreign Exchange Management (Permissible Capital Account Transactions) Regulations, 2000 it can be noted that you can undertake derivative contracts. This is USD 250,000 per financial year. This has been introduced with effect from February 27, 2019 by the Foreign Exchange Management (Permissible Capital Account Transactions) (Amendment) Regulations, 2019, vide Notification no. FEMA 391/2019-RB dated February 26, 2019 published in the Official Gazette of Government of India [Extraordinary, Part II – Section 3, sub-Section (i)] dated February 27, 2019.
