He has further submitted that William Singh Sandhu has filed a civil suit against Jagdish Varinder Singh Sandhu and with a view to settle scores with him, Jagdish Varinder Singh Sandhu is instigating the complainant to lodge this complaint. According to him, the sale deed has been attested by a number of witnesses from whom Kaka Singh and Jagtar Singh have been left out of the case. He has further submitted that an attesting witness identifies the parties to the document and he does not vouch for the contents thereof. No submission is made before me by learned State counsel or learned counsel for the complainant that custodial interrogation of the petitioners is required in this case. The case is based on documentary evidence for its proof. When William Singh Sandhu, the main accused has already been arrested and released on bail, the petitioners appear to be entitled to pre-arrest bail. In view of the above, Criminal Misc. No.M-6600 of 2012 is allowed and it is ordered that the petitioner shall join the investigation and if he is sought to be arrested, he will be released on bail subject to the conditions laid down under section 438 (2)(i) to (iii .....
