lf assessment, Section 154 of Customs Act, 1962 is not applicable. However, recourse can be taken under Section 149 of Act ibid since documentary evidence in form of invoice showing correct value was existing at the time of clearance of goods. (2) Section 149 is silent on time limit. (3) You may file all relevant documents i.e copies of import documents including invoice. Even after that, your request is denied, you may have to request the Authority to pass a speaking order rejecting your request so that you may file an appeal before the Commr. Appeals . nery parts vide invoice no. 3506445/2000 dated May 10, 2011 valued at 997740.24 CHF vide Bill of Entry no. 3610581 dated May 25, 2011. The Appellant cleared the goods on payment of relevant Customs duties along with interest. Thereafter, the Appellant found that value of one item was shown as 4.04 CHF instead of 0.04 CHF.
