Accordingly, statutory notices u/s. 143(2) and 142(1) of the Act were issued and duly served on the assessee. We have carefully considered the submissions of the rival parties and perused the material available on record. We find that the facts are not in dispute. We further find that the Assessee hospital has received an order u/s 10(23C)(via) dated 31.3.2009 bearing F.No. CCIT/Mum/10(23C)(via)/235/2008- 09, Government of India, Ministry of Finance, Department of Revenue, Chief Commissioner of Income Tax, Mumbai, exempting the hospital u/s 10(23C) (via) from Assessment year 2000-01 and onwards until withdrawn. We further find that earlier the hospital has also received order dated 23.8.2004 .....
