Notification No.15/2017-ST 16/2017-ST dtd. 13.4.2017 introduced amendments that made the importer located in India fully liable for paying Service Tax in case of the services provided by the person located in non-taxable territory to a person located in non-taxable territory by way of transportation of goods by a vessel. The notifications did not provide for differential treatment for imports on CIF or FOB basis. Hence the Ocean Freight is Taxable at the hands of Importer under Service Tax effective 23.4.2017. As the place of removal is not defined in CENVAT Credit Rules, 2004 but Rule 2(t) of CCR, 2004 says that words and expressions used in these rules and not defined but defined in the Excise Act or Finance Act shall have the meanings respectively assigned to them in those acts.
