The investigations which are in progress could be hampered by the petitioner who, prima facie appears to be manipulative as reflected from certain emails written by her to the prime accused and to a person who was to be the sole arbitrator under the agreement of June, 2010 in the event there was any dispute with regard to the agreement - Under these circumstances, prayer for bail of the petitioner is rejected. The learned counsel for the C.B.I submits by relying on various clauses of the agreement that the aforesaid agreement can hardly be construed as an agreement which two business persons would enter into. This argument is countered by the learned counsel for the C.B.I by contending that when the Legislature has thought it fit not to incorporate the proviso to Section 437 of the Code of Criminal Procedure in Section 439 of the Code of Criminal Procedure, we cannot consider the proviso to Section 437 of the Code of Criminal Procedure under which certain categories or classes of people are to be rel .....

The magnitude of the offence cannot be lost sight of especially since the amount of public money which has been misused and misappropriated is huge.
