There is nothing in the entire agreement that would suggest that a new joint venture has been formed or a joint venture between the two companies has been established as a business. Nothing in the agreement suggests that the appellant and Sify have an agreement on Principal to Principal basis - in the present case based on the nature of the agreement the appellant is providing services to M/s Sify Limited which fall under the category of business auxiliary service. The main service provider or the principal M/s Sify Limited is the one who provides internet services to the customers and the appellant provides services to M/s Sify Limited using their cable network and manpower ensuring the last mile connectivity up to the users premises. The appellant also collects bills on behalf of M/s Sify Limited. 7. In view of the above, we find that the nature of agreement in this case is that of a principal and a service provider. The case laws relied upon by the appellant Ushakiron Television- 2019 (24) GSTL 267 (Tri.-Hyd.) and Old World Hospitality Limited 2017 (3) GSTL 178 (Tri. Del.) are different in as much as based on the specific details of the agreement in those cases, it was concluded that there was no service provider - service recipient relationship in those agreements. 8.
