The Appellate Tribunal CEGAT, Mumbai granted unconditional waiver of pre-deposit and stay of recovery of duty and penalty pending the appeal based on the case law cited by the applicants. The decision modified the earlier stay order directing pre-deposit of Rs. 5 lakhs towards customs duty.
