Summary

The Appellate Tribunal CEGAT, Mumbai directed the Commissioner of Customs to give a personal hearing to a CHA whose license was suspended without a hearing, following a distinct time lag between the case against the CHA's employees and the suspension order. The Commissioner must pass a speaking order on whether the suspension should continue within 4 weeks, or the suspension order will be vacated. This decision does not hinder the Commissioner from proceeding with the inquiry under Regulation 23.
