2006 (5) TMI 395 - AT - Central Excise

The applicant filed for waiver of pre-deposit of duty and penalty. The duty was confirmed but the capital goods in question were still in the factory. Pre-deposit of duty and penalty was waived for hearing of the appeal. Stay Petition was allowed.
