The Appellate Tribunal CESTAT, Mumbai set aside the penalty imposed on the appellants under Section 114 of the Customs Act, 1962 for failure to comply with procedure. The penalty was imposed for accepting packages containing concealed Indian Currency, but the tribunal found that the appellants were not aware of the smuggling and had followed proper procedures. The penalty was deemed unwarranted, and the appeals were allowed.
