The High Court of Delhi declined to answer questions referred by the Income-tax Appellate Tribunal regarding co-ownership of properties and taxation of capital gains among co-owners. The Tribunal held that capital gains from property sale should be taxed separately in the hands of co-owners, not the firm. The dispute was for the assessment year 1976-77.
