Seizure of watches and imposition of penalty:
The Appellant, represented by Senior Counsel, challenged the seizure of watches and imposition of a penalty of Rs. 30,000, along with the seizure of Indian currency amounting to Rs. 1,07,955. The Department suspected the watches to be of HMT-make and alleged that the contents inside were smuggled. The Appellant argued that the adjudication was based on suspicion and surmises, with charges unjustly brought against him. The Senior Counsel requested a stay on the realization of the demand due to contesting the seizure and confiscation.

Seizure of Indian currency:
The Department acknowledged the historical nature of the case, dating back almost 20 years, and agreed to examine the entire set of documents in the interim. Both sides were heard, emphasizing the importance of thoroughly examining the basic evidences collected during the seizure and thereafter. The Department still held the seized cash, leading to the conclusion that a stay on the penalty amount's realization was appropriate during the appeal process. The order was made to stay the realization of the penalty amount until further hearings scheduled for 7-11-2008.

Allegations of smuggling:
The case revolved around suspicions of smuggling, with the Department claiming that the contents inside the seized watches were illicit. The Appellant vehemently denied these allegations, asserting that the charges were baseless and not attributable to him. The Senior Counsel highlighted the lack of concrete evidence supporting the smuggling accusations, urging for a fair assessment of the situation.

Stay of realization of demand:
Considering the historical context of the case and the need for a detailed examination of the evidence, the Tribunal ordered a stay on the realization of the penalty amount.
