The application for waiver of pre-deposit of penalty of Rs. 7,17,799 imposed under Section 11AC of the Central Excise Act, 1944 is allowed by waiving pre-deposit and staying recovery pending appeal. The demand of service tax due to wrong credit has been reversed under protest by the applicants.
