2015 (4) TMI 1062 - HC - Service TaxWrit petition against the adjudication order - Though various grounds have been raised assailing the impugned orders this Court is not inclined to entertain the writ petitions as the impugned orders passed by the respondent are appealable under Section 85 of the Finance Act. - Petition dismissed for want of alternative remedy.
The High Court of Madras dismissed the writ petitions challenging orders of the Commissioner of Central Excise, Coimbatore, stating that the orders are appealable under Section 85 of the Finance Act. The court ruled that the writ petitions cannot be maintained without availing the alternative remedy of filing an appeal before the Appellate Tribunal. The petitioners were granted two weeks to file an appeal, and the writ petitions were dismissed with no costs.
