2010 (2) TMI 1235 - AT - Income Tax

Issues involved: Appeal against CIT(A) order for addition u/s 69C of the I.T. Act for unexplained expenditure on commission and cost of shares.

Issue 1 - Unexplained expenditure on commission:
The assessee obtained artificial capital gain through share transactions. Allegations were admitted, and long term capital gains were declared. The addition u/s 69C was made for unexplained expenditure on commission at 5% of sale proceeds. Tribunal held that no evidence was found to prove the expenditure, and addition based on surmises and conjectures was not justified. Ground No. 1 allowed.

Issue 2 - Unexplained expenditure on cost of shares:
The assessee offered entire sale proceeds to tax, but AO added purchase cost u/s 69C alleging the purchase was a bogus transaction. Tribunal ruled that if entire sale proceeds are taxed, no separate addition is warranted u/s 69C. Ground No. 2 allowed.

General grounds:
Grounds 3 and 4, being general in nature, were not adjudicated.

In conclusion, the appeal of the assessee was allowed by the Appellate Tribunal ITAT Mumbai, with the order pronounced on February 26, 2010.
