The Subordinate Judge upheld the decree of the District Munsif, finding the plaintiff guilty of negligence. The plaintiff's presence in court did not constitute an appearance for the purposes of Order 41, Rule 17. The case falls under Order 17, Rule 3, and the suit was dismissed on the merits, not for default. The Second Appeal was dismissed with costs.
