The High Court of Bombay upheld the order passed in a writ petition under Article 226 of the Constitution of India. The petitioners were allowed temporary occupancy of premises during construction of new flats, but had no rights in the suit premises after taking possession of the new flats. The property vested in the Central Government under the Income-tax Act, and the appeal was dismissed. The operation of the order was stayed for two weeks, and the time to make payment under the Act was extended. Appellants were required to give advance intimation if they intended to challenge the order in a higher court.
