2014 (5) TMI 484 - HC - CustomsSealing of premises - investigation under Section 53 of the Narcotic Drugs & Psychotropic Substances Act 1985 - Held that - The Directorate of Revenue Intelligence has desealed the premises and handed them over to the petitioner. The petition has therefore been rendered infructuous. However before disposing of the writ petition it would be appropriate to remind the Directorate of Revenue Intelligence that it is required to conclude investigation expeditiously. A perusal of the original record reveals that apart from addressing letters and seeking replies from various persons no concrete steps have been taken in the matter. In case the premises in dispute were being used as a laboratory to manufacture narcotics the investigation should have concluded. The respondents are directed to conclude investigation expeditiously and proceed in accordance with law failing which the matter be placed before the head of the Directorate of Revenue Intelligence for taking appropriate action against officers responsible for this delay.
The Punjab and Haryana High Court directed the Directorate of Revenue Intelligence to conclude an investigation under the Narcotic Drugs & Psychotropic Substances Act, 1985 expeditiously. The premises in question were desealed and handed over to the petitioner, rendering the petition infructuous. Failure to conclude the investigation promptly may result in action against responsible officers. The case was disposed of accordingly.
