The High Court of Karnataka, in a judgment dated 2009 (7) TMI 1356, heard an appeal filed by a plaintiff against a trial court order rejecting his application under Order 39 Rules 1 and 2 of CPC. The plaintiff filed a suit for permanent injunction and an application for temporary injunction, which was initially granted ex parte by the trial court. However, the trial court later rejected the application, resulting in the plaintiff filing an appeal. The High Court directed the parties to maintain status quo regarding possession of the suit property until the suit's disposal and ordered the trial court to expedite the suit's resolution.
