The High Court of Calcutta dismissed the second appeals regarding abatement of rent under Section 38 of the Bengal Tenancy Act. The Court held that the deterioration of land is permanent with reference to existing conditions, even if it may be restored in the future. The appeals were dismissed, with each party bearing their own costs.
