The High Court of Calcutta ruled that a suit on an instalment bond was barred by limitation as the plaintiffs did not waive the right to sue after default. The lower Appellate Court held that the suit was barred in respect of the first four instalments. The appeal was decreed in favor of the defendants, setting aside the lower courts' decrees and dismissing the plaintiffs' suit. The appellants were awarded costs in all courts.
