2019 (5) TMI 1957 - HC - Income TaxApplication to recall the order not been listed - order closing right of the Department to file written statement - HELD THAT - Let the I.A. filed by the Income Tax Department be numbered. Income Tax department submits that he has filed an application for recall of the order 2018 (11) TMI 1911 - DELHI HIGH COURT which has not been listed - as already filed his response to the suit by way of an affidavit filed by the Income Tax Department. Plaintiff submits that he has no objection if the said affidavit is taken on record. The order by which the right of the Department to file written statement was closed is recalled. I.A. is disposed of. Whether the Plaintiff - IFCI Factors Limited or the Income Tax Department has a preferred lien in respect of the fixed deposit lying with the Bank of India Defendant No.1. - As Counsels for the parties submit that no oral evidence would be required in this matter. List on 22nd July 2019 for hearing.
