Seeking approval of the Resolution Plan - Categorized as Unsecured Financial Creditor - correct or not - Section 30(6) r/w Section 31 of the Insolvency and Bankruptcy Code 2016 NCLAT has dismissed the appeal 2019 (12) TMI 1490 - NATIONAL COMPANY LAW APPELLATE TRIBUNAL NEW DELHI stating that As the case of the Appellant- Tourism Finance Corporation of India Limited was not covered by any of the grounds mentioned in Section 61(3) and this Appellate Tribunal cannot decide the question of fact relating to whether it is a Secured Creditor or Unsecured Creditor we are not inclined to interfere with the impugned order dated 27th February 2019. Supreme court dismissed the appeal stating that We find no merit in this appeal.
