2021 (6) TMI 1128 - HC - Service TaxSeeking permission for withdrawal of petition - petiitoner does not press for the present petition at this stage with a view to file an appropriate application filed by the Partnership Firm in which the present petitioner is the partner. HELD THAT - Without expressing any opinion on the merits of the present petition learned Advocate Mr. Mansuri is permitted to withdraw the present petition. It is needless to say that the application that may be filed by the petitioner in Special Civil Application No.23250/2019 shall be considered in accordance with law. The present petition stands dismissed as withdrawn.
The Gujarat High Court dismissed the petition as the petitioner decided to withdraw it to file a new application in a different case. The court permitted the withdrawal without expressing any opinion on the merits of the petition.
