2008 (6) TMI 90 - AT - Service TaxApplication for restoration of the appeal dismissed for non-compliance of the stay order - submission that the applicant moved Writ Petition before the HC - High Court directed the applicant to deposit a sum of Rs. 2 lakhs within a period of one month - since Tribunal dismissed the appeal prior to the passing of the order of HC there is no merit in impugned application hence dismissed
The appeal was dismissed for non-compliance of the stay order. The High Court directed the applicant to deposit Rs. 2 lakhs within one month to avoid dismissal of the appeal. The Tribunal had already dismissed the appeal before the High Court's order, so the application for restoration was dismissed.
