2007 (12) TMI 205 - HC - CustomsPetitioners seeks implementation of the order passed by the CESTAT - order passed in July 2006 cannot be kept unimplemented for the simple ground that the copy of the order has not been received by the Customs Department - in order to ascertain as to whether any step was taken to obtain the order Assistant Registrar of CESTAT is requested to furnish a Report on the aspect of the service of the order in terms of sub-section 3 of Section 129B of the Customs Act
The High Court of Calcutta addressed a writ petition seeking implementation of an order from the Customs, Excise and Service Tax Appellate Tribunal. The Customs Authorities claimed the order was not served to them as required by law. The court requested a report from the Assistant Registrar to verify the service of the order. The case was scheduled to be reviewed the following Thursday.
