The High Court of Bombay ruled in favor of the petitioners, trustees of Bhoruka Charitable Trust, stating that the Income Tax authorities cannot reopen assessment without disclosing the material for doing so. The court found the notices served under section 148 of the Income Tax Act to be illegal and without substance. The petition was admitted, and the rule was made absolute with no order as to costs.
