2021 (2) TMI 657 - HC - CustomsRelease of detained goods - allegation is that the goods illegally held by the accused have not been released - HELD THAT - There is no such order made by this Court about releasing the goods. Therefore it cannot be held that there is a breach of the order passed by this Court on 16thOctober 2020. Hence no case is made out to initiate proceedings under the Contempt of Courts Act 1971. However it will be open for the complainant to file appropriate proceedings seeking release of the goods.
The Karnataka High Court dismissed an appeal by the Commissioner of Customs on October 16, 2020. The accused did not release goods as alleged by the complainant, but the court found no breach of the order as it did not direct the release of goods. No contempt of court proceedings initiated. Complainant can file appropriate proceedings for goods release.
