The High Court at Calcutta quashed the Collector's order denying stay of demand and directing deposit of penalty, stating that the Collector failed to consider the petitioner's hardship as a sick industry. The Court found the Collector's handling of the case inadequate and ordered the appeal to proceed without pre-deposit. The writ petition was finally disposed of.
